FAQ Friday: What Happens When You Enter Something Wrong On Form 2290?

Form 2290 should be filed by drivers of vehicles weighing 55,000 pounds or more annually to the IRS for the Heavy Vehicle Use Tax. It is important to file this form, failing to do so will result in late penalties from the IRS. In order to file Form 2290 you will need to provide specific information for the IRS to know who is filing the form and that the form is being filed for.

What information is needed to file Form 2290?

To file Form 2290 you need to enter your correct business information including your Employer Identification Number (EIN), vehicle information including your Vehicle Identification Number (VIN), credit vehicles you plan to claim if any, and your payment information. 

What happens if you enter the wrong information?

When filing Form 2290 it is entirely possible to make a mistake. You may enter the wrong number for your EIN or VIN or even the wrong weight, mileage, or address into the form. If you make any of these mistakes, the process for fixing them depends entirely on the mistake that was made. 

Wrong VIN

When the VIN is entered incorrectly, the process for correcting it depends on how many characters the VIN was off by. If the VIN was off by only a few characters, you are able to file a Form 2290 VIN correction amendment in order to correct it. If the entire VIN is wrong, a new Form 2290 needs to be filed and Form 8849 must be filed in order to let the IRS know that the original Form 2290 was not correct and request they move the tax to the new form for the tax paid on the original form. This only applies if they have already paid the taxes.

Wrong Weight class

When the wrong weight class is entered, the process of correcting it will depend on whether the weight was more or less than the actual weight of the vehicle. If the weight was reported as being less than it actually is, a Form 2290 Amendment for weight increase must be filed and then you will pay the rest of the tax amount that is owed. If the weight is actually less than what was originally put on the original Form 2290, you must file a new Form 2290 and then file Form 8849 to request the original tax amount back after paying the new tax amount. 

Wrong Mileage

If a qualifying vehicle drives less than 5,000 miles a year or less than 7,500 miles a year if it is used for agricultural purposes, it is considered suspended by the IRS. Form 2290 still needs to be filed in this case but no tax will be owed for this vehicle. If a vehicle is filed as suspended but then exceeds the mileage limit, a Form 2290 Amendment for mileage exceeded must be filed and then the full tax amount for the year must be paid. If Form 2290 was filed as not suspended and the vehicle was actually suspended, Form 8849 must be filed to request the tax amount for that vehicle back to you. 

Wrong Address

If the wrong address is put into Form 2290, in order to correct this a new Form 2290 must be filed. Then you must file Form 8849 for this vehicle to request that the original tax amount paid be returned to you. 

Wrong business name/name/EIN

If the wrong EIN or business name is entered into Form 2290, a new Form 2290 must be filed and the tax must be paid for the new form. You must then file Form 8849 for this vehicle to request that the original tax amount paid be returned to you.

What is Form 2290?

When is Form 2290 Due?

The deadline to File Form 2290 for the 2022-23 tax year was August 31st but don’t worry, you can still file Form 2290. Form 2290 is now past due and while there will be fines for filing late, the fines will only keep increasing if you keep waiting to file. 

What are the penalties for filing late?

If you do need to file Form 2290 late, you will be charged late fines. The fine for not filing Form 2290 altogether is actually greater than the fine for not paying the tax. This is why it is important to file Form 2290 as soon as possible and pay the Heavy Vehicle Use Tax as soon as you have the means to do so. 

For every month the deadline is missed and Form 2290 is not filed, there will be a fine of 4.5% of the total tax due added for up to five months. If you underpay for the Heavy Vehicle Use Tax, there will be an automatic penalty of 0.5% of the tax due. Additional interest charges of 0.54% accrue each month that Form 2290 is not filed. This is why it is important to not only file Form 2290 but pay the Heavy Vehicle Use Tax as well.

It is important to meet the requirements for this deadline to avoid hefty penalties given by the IRS. No one wants to pay more than they need to, so file now to avoid missing the deadline.

The important deadline that is just right around the corner is the Form 2290 and HVUT payment due date. The Form 2290 must be filed and the HVUT payment must be made to the IRS by the end of August 31st, 2021.

E-Filing Form 2290 vs Making Your HVUT Payment

So you filed your Form 2290 and received your stamped Schedule 1? That’s great!…. but unfortunately you’re not done quite yet.

It is now time to pay the IRS the tax due on your vehicles. You can only make your HVUT payment after your Form 2290 was completed and accepted by the IRS. Filing and paying your HVUT are two different processes, so It’s important that you complete both of them before the deadline. 

When is the Form 2290 due date and when do you have to Pay?

Both the Form 2290 and your HVUT payment are due by the same date, which is determined by your first used month. If you have a vehicle that was used for the first time during the tax year (bought new or used vehicle,etc) then the due date to file and pay would be the end of the following month of first use.

If the truck has been in use since the last tax year, then your due date will be on August 31st!

Even though the filing and payment are due on the same day, it is important that you don’t wait to file and pay. Your Form 2290 must be accepted before the payment is made or the IRS will not be able to process your payment.

Some payment options take a few days or weeks to be sent and accepted by the IRS. Even if the payment is sent on time, if it is not in the IRS’s hands by the end of the due date, then your HVUT will be considered late and penalties will be involved. 

File now to ensure that your Form 2290 will be accepted and that, regardless of the method you choose to make the payment, your HVUT will be received at the IRS on time.

How To Pay Your HVUT to the IRS?

The IRS offers multiple options to make your HVUT payment. It’s important that you understand all these options so you can best determine which form of payment is the best option for you. 

  • Debit and Credit Card- to make your HVUT payment using your debit and credit cards, you must make your payment at IRS.Gov/PayUsingCard 
  • Electronic Funds Withdrawal (EFW)– a standard bank account transfer. You will need to provide your bank account and routing numbers to the IRS. The payment will be withdrawn within 1 or 2 business days
  • Electronic Federal Tax Payment Systems (EFTPS) a service that the IRS offers to simplify tax payments. You will have to create an account here and enroll in the program.
  • Check or Money Order If you choose this option, you will have to remember to mail out your check or money order before the HVUT payment due date. You will also have to include the Form 2290-V along with the payment. Mail it to the following address:

Once you submit your Form 2290, the payment method that you checked can be changed, unless you picked the EFW option. So, before you submit your tax return, make sure the payment option that you picked is the one you’re committed to using. 

Why Can’t You Pay the IRS Through ExpressTruckTax?

The HVUT payment must be paid directly to the IRS. ExpressTruckTax does not initiate any of the HVUT payments and cannot accept the tax money.
