Can I File IRS Form 2290 Without an EIN?

Unfortunately, the answer is no. The IRS requires ANY taxpayer filing a Form 2290 to use an EIN or Employer Identification Number when filing. The IRS expressly prohibits the use of social security numbers for the filing of 2290.

We receive many questions from taxpayers who believe they’re not a business – simply a driver. In these cases, you still need to have a business such as a sole proprietorship.

To get an  Employer Identification Number from the IRS, you can follow one of the following options:

  • Apply Online: The customer can obtain an EIN immediately by visiting IRS Online EIN application
  • Apply over the phone: Taxpayers can obtain an EIN immediately by calling the Business & Specialty Tax Line at (800) 829-4933. The hours of operation are 7:00 a.m. – 10:00 p.m. local time, Monday through Friday. An assistor takes the information, assigns the EIN, and provides the number to an authorized individual over the telephone. Note: International applicants must call (215) 516-6999 (Not a toll-free number).
  • Apply Fax: Fax the completed form SS-4 to IRS. If you provide a return fax number, IRS will send a fax to that number within 4 days with a new EIN.
  • Apply through Paid Provider: You can use a CPA or a process agent, like Truck Services of North America and let them take care of preparing and filing the return for you.
  • Apply by Mail: This is the slowest way to get the EIN number. mail the completed Form SS-4 to the IRS. The address is listed on the form itself. This could take up to 4 weeks to get the EIN number.

NOTE: Remember, for vehicles first used in June, the due date to file your Form 2290 is July 31, 2013. While you can get your EIN immediately, it can take the IRS up to 10 business days to update new EINs into their system. You cannot E-File your Form 2290 until your EIN is is the system, so you will want to get your EIN today to ensure you can file by the deadline!

Understanding Your HVUT Responsibilities

What is HUVT?
HVUT is the Heavy Vehicle Use Tax that is a fee assessed annually on heavy vehicles operating on public highways at registered gross weights equal to or exceeding 55,000 pounds. The gross taxable weight of a vehicle is determined by adding the unloaded weight of the motor vehicle and any trailers together with the maximum load customarily carried on-road by the truck-trailer combination.

Who Must File?
You must file Form 2290 for the tax period beginning on July 1, 2013, and ending on June 30, 2014, if a taxable highway motor vehicle is registered, or required to be registered, in your name under state, District of Columbia, Canadian, or Mexican law at the time of its first use during the period and the vehicle has a taxable gross weight of 55,000 pounds or more.  The deadline to file is August 31, 2013.

What is Required?
You need the details of your business – Business Name (Sole proprietor can use their legal name) and address, EIN (Employer Identification Number) , details of the authorized signatory.

You need the details of your vehicle – Vehicle Identification Number (VIN) and Gross weight of the Vehicle

If you are going to pay the IRS by direct debit (we strongly recommend it), keep the routing number and the account number ready.

When to File?
Heavy Vehicle Use Taxes must be filed using the Form 2290 on an annual basis. The Tax period for Heavy Vehicles begins on July 1st and ends on June 30th of the following year. The annual renewal of your Form 2290 for a new tax period IS DUE BY August 31st each year.

For new vehicles placed in service, the IRS Form 2290 must be filed by the last day of the month following the month of first use. For example, if you purchase and first use a vehicle in October, you must file a Form 2290 by the end of November.

How to File?
Electronically.  File Form 2290 electronically through any electronic return originator (ERO), transmitter, and/or intermediate service provider (ISP) participating in the IRS e-file program for excise taxes, such as ExpressTruckTax.com. Paper.  Mail Form 2290 to the address shown under Where To File. If you did not pay the tax using the Electronic Funds Transfer or Electronic Federal Tax Payment System (EFTPS), mail Form 2290-V and your check or money order with Form 2290.

June 30th Deadline for Heavy Vehicles First Used in May 2013

As stated in the Form 2290 instructions found on irs.gov, the Form 2290 must be filed by the last day of the month following the month of first use. June 30th  marks the Form 2290 filing deadline for any heavy vehicles that were first used in May 2013.

Any vehicles used less than 5,000 miles (7,500 miles agricultural) during the tax period will have no tax due to the IRS, but are still required to file their Form 2290 return to avoid any penalty.

If you are filing Form 2290 for Heavy Vehicle Use Tax (HVUT), you must have an EIN to file the return. The IRS does not accept Social Security Numbers for the Form 2290. Filing Period Now Open For First Used Vehicles in May 2013

When a new vehicle is placed in service, the Form 2290 must be filed by the last day of the following month. So vehicles that were placed in service during the month of May will need to file HVUT using the 2290 by June 30th.

Your tax will be prorated based on the number of months the vehicle will have been used during the tax year. If a vehicle was used during any part of a month, the tax will be calculated for that month as a whole. For example, if a vehicle was used on May 27th, it will be taxed as though it was used the entire month, regardless of the fact it was only used for a couple of days, and the tax will be based on 2 months, instead of the full year.
