Form 2290 Credit Vehicles

IRS Form 2290, Highway Heavy Vehicle Use Tax claiming credit for the following scenarios:

  • You can take credit for the vehicle if it was stolen, destroyed or sold before June 1 and not used during the remainder of the period, or
  • Used during the prior period 5,000 miles or less (7,500 miles or less for agricultural vehicles).

A credit, lower tax, exemption, or refund is not allowed for an occasional light or decreased load or a discontinued or changed use of the vehicle.  What that means is if you filed your Form 2290 at 80,000 lbs, but had occasions where you operated at a lower weight class, that will not qualify you for a credit.  If you used your vehicle for only a portion of the tax year, you will qualify for the credit IF you did not exceed 5,000 miles (7,500 miles for agricultural vehicles).  If you did travel more than 5,000 miles (7,500 miles for agricultural vehicles) then you will NOT qualify for the credit.

The credit for vehicles that were stolen, destroyed or sold during the tax year will be prorated based on the dates of the occurrence.  For vehicles sold, destroyed or stolen, you must include the VIN, taxable gross weight, and date of sale, accident or theft. The credit for the tax paid can be claimed on the next Form 2290 filed or the refund can be claimed on Form 8849.  You do not have to wait until the tax period ends.

The credit for low mileage vehicles you either qualify for it and you will get the full amount that you paid as a credit or you will not qualify and you will not get any portion of the credit.  This credit is never prorated. For vehicles that tax was paid and the vehicles were used 5,000 miles or less (7,500 miles or less for agricultural vehicles), the credit (or refund) cannot be claimed until the end of the tax period for which the initial tax was paid.  Even if you know at some point during the tax year that you will not exceed the 5,000 mile mark, you will not be able to claim the credit until the tax period ends, which is on June 30th.
The credit claimed cannot exceed the tax reported on Form 2290. If this occurs, any excess credit must be claimed using Form 8849, Claim for Refund of Excise Taxes, and Schedule 6, Other Claims. EIN Is REQUIRED to File Form 2290

If you are filing Form 2290 for Heavy Vehicle Use Tax (HVUT), you must have an EIN to file the return. The IRS does not accept Social Security Numbers for the Form 2290. An EIN is an Employer Identification Number, also known as a Federal Tax Identification Number, and can be used to verify a business entity.

If you do not have an EIN, you can apply for one online through the IRS website or if you don’t have the time or unable to get to a computer, you can have a service provider, like Truck Services of North America to do it for you.

NOTE: Remember, for vehicles first used in August, the due date to file your Form 2290 is September 30, 2013. While you can get your EIN immediately, it can take the IRS up to 10 business days to update new EINs into their system; so you will want to get your EIN today to ensure it is in the system by the deadline!

E-File Form 2290 for Heavy Vehicles First Used in August 2013

Although the HVUT, or the Heavy Vehicle Use Tax is imposed annually, it is also mandatory for vehicles to file the IRS Form 2290 after the first use month. The typical tax year for heavy vehicles begins on July 1 and ends on June 30. For vehicles that are first used during the tax year, a prorated tax must be paid for the months that the vehicle was in use. This can be done with the IRS Form 2290 and the easiest way to file the 2290 is through ExpressTruckTax.com


When a new vehicle is placed in service, the Form 2290 must be filed by the last day of the following month. The tax will be prorated based on the number of months the vehicle will have been used during the tax year. If a vehicle was used during any part of a month, the tax will be calculated for that month as a whole. What Is Form 2290?

 

The IRS Form 2290 is used to file Heavy Vehicle Use Taxes, or HVUT as it is commonly known. The Form 2290 must be filed on an annual basis for every Heavy vehicle weighing at least 55,000 pounds.

EIN Necessary To File Form 2290

The IRS requires ANY taxpayer filing a Form 2290 to use an EIN or Employer Identification Number when filing. The IRS expressly prohibits the use of social security numbers for the filing of 2290.
We receive many questions from taxpayers who believe they’re not a business – simply a driver. In these cases, you still need to have a business such as a sole proprietorship.

To get an  Employer Identification Number from the IRS, you can follow one of the following options:

  • a. Apply Online: The customer can obtain an EIN immediately by visiting IRS Online EIN application
  • b. Apply over the phone: Taxpayers can obtain an EIN immediately by calling the Business & Specialty Tax Line at (800) 829-4933. The hours of operation are 7:00 a.m. – 10:00 p.m. local time, Monday through Friday. An assistor takes the information, assigns the EIN, and provides the number to an authorized individual over the telephone. Note: International applicants must call (215) 516-6999 (Not a toll-free number).
  • c. Apply Fax: Fax the completed form SS-4 to IRS. If you provide a return fax number, IRS will send a fax to that number within 4 days with a new EIN.
  • d. Apply through Paid Provider: You can use a CPA or a process agent, like Truck Services of North America and let them take care of preparing and filing the return for you.
  • e. Apply by Mail: This is the slowest way to get the EIN number. mail the completed Form SS-4 to the IRS. The address is listed on the form itself. This could take up to 4 weeks to get the EIN number.
