If a highway motor vehicle does not exceed mileage 5,000 miles or less (7,500 miles or less for agricultural vehicles) it is considered suspended and is exempt from tax. Mileage use limit means the use of a vehicle on public highways 5,000 miles or less (7,500 miles or less for agricultural vehicles). The mileage use limit applies to the total mileage a vehicle is used during a period, regardless of the number of owners.

        Must Have EIN to File Form 2290

        The IRS requires ANY taxpayer filing a Form 2290 to use an EIN or Employer Identification Number when filing. The IRS expressly prohibits the use of social security numbers for the filing of 2290.

        We receive many questions from taxpayers who believe they’re not a business – simply a driver. In these cases, you still need to have a business such as a sole proprietorship.

        To get an  Employer Identification Number from the IRS, you can follow one of the following options:

        • Apply Online: The customer can obtain an EIN immediately by visiting IRS Online EIN application
        • Apply over the phone: Taxpayers can obtain an EIN immediately by calling the Business & Specialty Tax Line at (800) 829-4933. The hours of operation are 7:00 a.m. – 10:00 p.m. local time, Monday through Friday. An assistor takes the information, assigns the EIN, and provides the number to an authorized individual over the telephone. Note: International applicants must call (215) 516-6999 (Not a toll-free number).
        • Apply Fax: Fax the completed form SS-4 to IRS. If you provide a return fax number, IRS will send a fax to that number within 4 days with a new EIN.
        • Apply through Paid Provider: You can use a CPA or a process agent, like Truck Services of North America and let them take care of preparing and filing the return for you.
        • Apply by Mail: This is the slowest way to get the EIN number. mail the completed Form SS-4 to the IRS. The address is listed on the form itself. This could take up to 4 weeks to get the EIN number.

        NOTE: Remember, the due date to file your Form 2290 for vehicles first placed on public highways in September is October 31, 2013. While you can get your EIN immediately, it can take the IRS up to 10 business days to update new EINs into their system. You cannot E-File your Form 2290 until your EIN is is the system, so you will want to get your EIN today to ensure you can file by the deadline!

        Recordkeeping Requirements for Registered Highway Vehicles

        Below is taken directly from the Instructions for Form 2290 found at irs.gov:

        Keep records for all taxable highway vehicles registered in your name for at least 3 years after the date the tax is due or paid, whichever is later. They must be available at all times for inspection by the IRS. Also keep copies of all returns and schedules you have filed. Keep your records even if a vehicle is registered in your name for only a portion of a period. If the tax is suspended on a highway motor vehicle for a period because its use on public highways during the period did not exceed 5,000 miles (7,500 miles for agricultural vehicles), the registrant must keep the records at least 3 years after the end of the period to which the suspension applies.

        Records for each vehicle should show all of the following information.

        • A detailed description of the vehicle, including the VIN.
        • The weight of loads carried by the vehicle in the same form as required by any state in which the vehicle is registered or required to be registered.
        • The date you acquired the vehicle and the name and address of the person from whom you acquired it.
        • The first month of each period in which a taxable use occurred and any prior month in which the vehicle was used in the period while registered in your name, with proof that the prior use was not a taxable use.
        • The date the vehicle was sold or transferred and the name and address of the purchaser or transferee. If it was not sold, the records must show how and when you disposed of it.
        • If the tax is suspended for a vehicle, keep a record of actual highway mileage. For an agricultural vehicle, keep accurate records of the number of miles it is driven on a farm.

        Form 2290 Filing Period Now Open For Vehicles First Used In September

        When a new vehicle is placed in service, the Form 2290 must be filed by the last day of the following month. So vehicles that were placed in service during the month of September will need to file HVUT using the 2290 by October 31st.

        Your tax will be prorated based on the number of months the vehicle will have been used during the tax year. If a vehicle was used during any part of a month, the tax will be calculated for that month as a whole. For example, if a vehicle was used on September 20th, it will be taxed as though it was used the entire month, regardless of the fact it was only used for a couple of days, and the tax will be based on 10 months, instead of the full year.

        Deadline Today for Heavy Vehicles First Used in August 2013

        As stated in the Form 2290 instructions found on irs.gov, the Form 2290 must be filed by the last day of the month following the month of first use. September 30th  marks the Form 2290 filing deadline for any heavy vehicles that were first used in August 2013.

        Any vehicles used less than 5,000 miles (7,500 miles agricultural) during the tax period will have no tax due to the IRS, but are still required to file their Form 2290 return to avoid any penalty.
