A privately purchased vehicle is a vehicle that has been purchased from a private seller and not a dealership, an auto auction, or leased from a carrier or leasing company.

Buying a Privately Owned Vehicle

If you purchase a vehicle weighing 55,000 pounds or more you must file Form 2290 for the Heavy Vehicle Use tax for this vehicle. If the First Used Month of your vehicle is during the month of the sale, your total Heavy Vehicle Use Tax for the vehicle will not include the tax for the month of the sale. If this is the case, the deadline to file Form 2290 will remain the same. 

The First Used Month of a vehicle refers to the month in which the vehicle was put on the road for the first time. You have until the last day of the following month to pay your Heavy Vehicle Use Tax. When you purchase a privately owned vehicle, the same rules apply except the amount of taxes you will pay will not include the First Used Month. For example, if you purchase a vehicle of a qualifying weight in January and start operating it in January, your Heavy vehicle use tax will not include tax for January, and the deadline to file Form 2290 will be the last day of February.

Selling a Privately Owned Vehicle

If you sell a privately owned vehicle, you can claim a credit for this vehicle next time you file Form 2290 for a different vehicle. If you are not planning to file Form 2290 for a different vehicle it is recommended that you file Form 8849. The IRS Form 2290 Due Date for the 2022-23 Tax Year

What is Form 2290?

Form 2290 is an IRS tax form for the Heavy Vehicle Use Tax (HVUT). This tax needs to be filed by drivers of vehicles weighing 55,000 pounds or more. If a qualifying vehicle drives less than 5,000 miles a year, or less than 7,500 miles a year if the vehicle is used for agricultural purposes, IRS Form 2290 must still be filed for this vehicle. In this case, the vehicle is considered suspended by the IRS. When it is considered suspended, no tax will be owed to the IRS for this vehicle. If a qualifying vehicle is not suspended the tax amount owed will depend on the vehicle’s Taxable Gross Weight and the vehicle’s First Used Month (FUM). Filing Form 2290 guarantees that the driver will receive a Stamped Schedule 1, which is required when getting the vehicle’s registration and tags. 

When is the Form 2290 Due?

When Form 2290 is due depends on the vehicle’s First Used Month, especially if the vehicle has been on the road for less than a year. In this case, the payment for the Heavy Vehicle Use Tax will be due on the last day of the following month. For example, if you put your vehicle on the road in September, you should file your Form 2290 in September but you will have until the last day of October to pay the Heavy Vehicle Use Tax to the IRS. 

If the vehicle has been on the road for more than a year or is being put on the road for the first time in July, the vehicle’s First Used Month will be July. This means that the deadline to pay the Heavy Vehicle Use Tax to the IRS will be August 31st. The Heavy Vehicle Use Tax is always paid for the upcoming tax year. The tax year for Form 2290 goes from July 1st to June 30th. This means that the Form 2290 due date 2022 is August 31st, 2022 for the 2022-23 tax year.

What Information is Required to E-file Form 2290?

When going to file the 2290 Form, the IRS recommends that it is filed online through an authorized e-filer. This is because if you paper file with the IRS, it will take several weeks before you get your Stamped Schedule 1.

Another option you are able to choose from is electronic funds withdrawal (EFW). For this option, you will be required to enter your checking or savings account information and your tax amount will be withdrawn from your account within a couple of days of the IRS accepting your Form 2290. 

If you select EFTPS as your payment method, you will need to go to EFTPS.gov and make your payment there. In order to utilize this payment method, you will either need an existing account with EFTPS or create one. Please note that it may take up to 15 business days for your account to become active. 

Lastly, you are able to send in your payment via check or money order. You will receive a voucher with the information on where to send your payment to. Include this voucher with your payment when you mail it in. With this option, you are able to send in the payment at your convenience as long as it is postmarked before or by August 31st.

What is Form 2290?

If you drive a vehicle that has a Taxable Gross Weight of over 55,000 pounds and drives over 5,000 miles a year, 7,500 miles if the vehicle is used for agricultural purposes, then the 2290 Form must be filed and the Heavy Vehicle Use Tax (HVUT) must be paid. If a vehicle travels less than 5,000 miles in a year or 7,500 miles for agricultural vehicles, it is considered suspended. In this case Form 2290 still needs to be filed, but you will be exempt from paying the HVUT.

What Information is Needed to File Form 2290?

Form 2290 requires several pieces of information to be filled out. The information entered helps determine how much tax is owed for the HVUT.

Business Name and Address

When you fill out Form 2290, it asks you for the name of the business you own or work for as well as the address of that business. The form will also ask you what type of business you work for. If you are unsure of the business type, you can select the “others or not sure” option.

EIN (Employer Identification Number)

Your Employer Identification Number (EIN) is required to fill out Form 2290. The EIN is a unique nine-digit number that is issued to every business owner by the IRS. If you just recently obtained an EIN, it could take up to 15 business days for it to become active and recognized by the IRS.

VIN (Vehicle Identification Number)

A Vehicle Identification Number (VIN) is a 17-digit code unique to each vehicle. Because no two vehicles have the same VIN number, it makes it easier to identify the vehicle. This number can be found on the vehicle’s registration, its title, or on the actual vehicle itself.

Taxable Gross Weight 

The Taxable Gross Weight of a vehicle is determined by adding the total weight of the truck, the trailer, and the maximum load the truck is able to carry. This is used to determine the tax amount that needs to be paid for the HVUT. The higher the Taxable Gross Weight of a vehicle, the higher tax owed. If a vehicle’s Taxable Gross Weight is less than 55,000 pounds, then Form 2290 does not need to be filed for this vehicle.  

First Used Month 

A vehicle’s First Used Month (FUM) is the month that you first put the vehicle on the road. The last day of the following month is when Form 2290 is due for the current tax year. If you first put a truck on the road in October of 2022, the deadline to file the 2022-2023 Form 2290 is November 30th, 2022. In this case, the rate is prorated since you are only filing for part of the tax year. 

The current tax year begins on July 1st, 2022, and ends on June 30th, 2023. If you have had your truck on the road for longer than a year, you will put your first use month as July and will be paying the full tax for the upcoming tax year.

Another option that is available to pay your HVUT is through the Electronic Federal Tax Payment System (EFTPS). In order to use this payment method, you must have a or create an account and initiate this payment transfer at www.EFTPS.gov

Credit or Debit card

The IRS also allows you to pay your HVUT via Credit or Debit card payments. After you file your Form 2290, you will go to IRS.gov/PayByCard to pay your HVUT with a Credit/Debit card. There will be a convenience fee charged for this service.
