Filing Form 2290 is done when your vehicle weighs over 55,000 pounds. If your vehicle travels less than 5,000 miles a year or 7,500 miles if it is used for agricultural purposes, you still have to file Form 2290 but you don’t have to pay the tax because your vehicle is then considered suspended/exempt. No matter if your vehicle is suspended/exempt or not when you file your Form 2290 you have to enter your first used month. 

What is a First Used Month?

The words “first used month” will appear several times in ExpressTruckTax and when you are filing your Form 2290. What does it mean? The first used month refers to the first month that you put your truck on the road during the specific tax year and does not have to do with the date on your tags. The Form 2290 tax year is July 1 to June 30.  If a truck has been put on the road for the first time in the middle of a tax year then the month you put the truck on the road will be your first used month. What Happens if You Choose the Wrong Business Type?

Don’t worry it happens, we all make mistakes. You can simply click your name in the upper-righthand corner and then click the drop-down arrow. You will then click on “My Account” which will lead you to a page with multiple options. From there select the option titled “Manage Businesses” by clicking on the pencil icon.

Do Your Drivers Need a 1099 or W-2?

Misclassifications continue to be a subject for concern among both companies and drivers, so it is a point that needs particular attention. So how should your fleet approaches classification?

When you bring on a new driver, you should determine if they are a full-time employee or an independent contractor. This should be priority number 1!

This will determine if they will receive a 1099 or W-2. Now, we’ve heard stories from some drivers where companies won’t discuss employee status until tax forms are due, but we suggest clear and open communication with your drivers from the very beginning.

1. What is my first use month?

Your first use month is literally the first month that you use your heavy vehicle during the tax period. The current HVUT period runs from July 1, 2017 to June 30, 2018 and form 2290 is due based off of your first use month.

To be specific, it’s due by the last day of the month following your first use month. Because most truckers use their trucks in July, it’s their first use month and that makes August 31st their deadline day. However, if you don’t use your truck until October then your Form 2290 wouldn’t be due until the last day of November.

2. Can I pay the amount of HVUT I owe with a credit card?

Unfortunately, no. You can not pay the amount of HVUT you owe with a credit card because the IRS doesn’t accept credit cards.

One option is to pay with direct debit or electronic fund withdrawal, by authorizing the IRS to debit the amount you owe from your bank account. In order to do this, you will need to provide your bank account and routing number which can be found on one of your checks.

Or you can also pay with the Electronic Federal Tax Payment System, where you will create a free account with www.ettps.gov. The amount you owe will be debited from your bank account, but it could take up to 10 days to create your account.

You will need to schedule your payment within your account. You need to schedule at least by 8 PM the day before the deadline to give the IRS enough time to debit the funds from your account.

If you want to, you can mail the amount you owe directly to the IRS with a check or money order. Just print your completed 2290-V (your payment voucher) from page 11 of your completed 2290 form and mail it with your payment.

3. What is an EIN?

Your EIN is your Employer Identification Number, and it’s used to identify a business entity. To complete Form 2290 you need an EIN and can apply for one online with the IRS. If you already have an EIN it can be found on a previous stamped Schedule 1.

You can not use your Social Security Number in place of your EIN on HVUT Form 2290. If you use your SSN instead of your EIN your form will be rejected. If you need an EIN you better hop to it because it takes about 14 days for your EIN to become active in the IRS’s system and your form could get rejected during that time.

4. How Do I file?

Forget to File Form 2290? You’re Going to Face Penalties!

Heavy Vehicle Use Tax (HVUT) deadline on August 31st. You still have about two weeks to file, but don’t wait. You should still file as soon as you can.

If you run into errors and your form gets rejected then you will be responsible for correcting your form and retransmitting it by the deadline. If your Form 2290 or HVUT payment is late you will have a few penalties to face.

HVUT Penalties

You may not receive a penalty for filing your return or paying the amount of HVUT tax you owe by the deadline if you are able to show reasonable cause for not filing or paying on time. If your file after the deadline be sure to attach an explanation to your return to show reasonable cause. The reasonable cause may then be accepted or rejected by the IRS.

Now the penalty for failing to file your HVUT IRS Form 2290 by the August 31 deadline is equal to 4.5% of the total tax due, and this penalty will accrue on a monthly basis for up to five months. The penalty for not making a HVUT payment is a monthly fee of .5% of the total tax due. You will also face an additional interest charge of .54% per month. This penalty can make the amount you owe increase pretty quickly.

Note: There are also penalties for filing fraudulent or false returns.

In addition to these federal penalties, your state may suspend your vehicle registration until you can provide proof of your HVUT payment. Your stamped Schedule 1 serves as your proof of payment, and you receive it by filing Form 2290. You need a stamped Schedule 1 to renew your tags and register new vehicles. Without it, you will be operating illegally.
