FAQ Friday: The Difference between No Operation, Amendment, and Final Return

No Operation

Vehicles that weigh 55,000 pounds or more that do not drive or operate during the tax year falls into this category. You do not have to file Form 2290 for these vehicles unless you put them on the road at any time during the course of the tax year. 

Amendment

Form 2290 amendments are available for filers to make corrections to their forms. There are three types of Form 2290 amendments that are available through ExpressTruckTax including VIN correction, Increase in Taxable Gross Weight, and Low Mileage Exceeded.

VIN Correction

If the VIN (Vehicle Identification Number) you entered into Form 2290 is off by only a few characters, you are able to file a Form 2290 VIN Correction Amendment. If it is the entire VIN or more than just a few characters that are wrong, you will need to file a new Form 2290 for the correct VIN and then a Form 8849 to request a refund for the tax amount paid on the original Form 2290. If you end up simply needing a VIN Correction and you filed your Form 2290 with ExpressTruckTax the VIN Correction will be free.

Increase in Taxable Gross Weight

If the Taxable Gross Weight of a vehicle increases or the wrong weight was originally entered and was less than the actual weight, you will have to file a Form 2290 weight increase amendment. You will file the amendment and then pay the difference of the tax that is now owed.

Low Mileage Exceeded

If you originally filed your vehicle as suspended on your Form 2290 and you ended up exceeding the mileage limit, you must file a Low Mileage Exceeded amendment and then pay the tax due for the entire tax year.

Final Return

A final return is filed when you are no longer planning to file Form 2290 for your vehicle because you sold your business, are not planning to drive your vehicle anymore, or for any other reason. It is a Form 2290 but you will select the final return and this lets the IRS know that you no longer plan to file Form 2290 so that they know they do not need to send you a yearly packet.

Gross Weight Increase

The Vehicle Identification Number (VIN) is a unique 17-character sequence that identifies each vehicle. You must enter this number on Form 2290 so that the IRS will know it is for that particular vehicle. Mileage Exceeded

If a vehicle weighs 55,000 miles or more but drives less than 5,000 miles a year, or less than 7,500 miles a year if it is used for agricultural purposes, it is considered suspended by the IRS.   1. Increase in Taxable Gross Weight

If, during the tax year that you filed Form 2290 for, the weight of your vehicle is increased and is placed into a different weight brackett, you will need to file a Taxable Gross Weight Amendment. 

To file a Taxable Gross Weight Amendment with ExpressTruckTax, follow these steps:

If you filed for a suspended vehicle for the tax return, but the vehicle went over the 5,000 miles (7,500 miles for agricultural vehicles), then you must file for a Mileage Limit Exceeded Amendment. 

To File a Mileage Limit Exceeded Amendment, follow the instructions below:

  • Log in to your account.
  • Click on “Start New Return” and select “Mileage Limit Exceeded” under “Form 2290 amendment.”
  • Choose whether you are filing Mileage Limit Exceeded Amendment for a return that was originally filed with us.
  • Provide the required information about your vehicle.
  • Your adjusted HVUT for the remaining year will be calculated automatically based on the vehicle’s weight category.
  • Check your return and transmit it to the IRS.

When Can I not file an Amendment?

Amendments are there for minor mistakes that are easy to make, like getting one number wrong on your VIN or not estimating your mileage correctly. Amendments cannot be used if larger more substantial errors occur. 

If you get important information completely incorrect, like your name, address, or the completely wrong VIN, you must file a Form 8849 in order to void your previous Form 2290, then you will need to re-file a Form 2290 with the correct information.

As the HVUT deadline races towards us, it’s important to remember to give yourself enough time to file our Heavy Vehicle Use Tax 2290 Forms to make it by the August 31st deadline. If you wait until the last minute to file and your form is rejected then it’s up to you to correct it and retransmit it to the IRS in time, otherwise, you will face late filing penalties.

Why 2290 Forms Are Commonly Rejected

EIN Problems

You need an EIN or Employer Identification Number to complete your Form 2290. There’s no way around it. Once you place your SSN in place of your EIN on your form then it will instantly be rejected.

If you need an EIN go apply for one with the IRS now because it takes about two weeks for them to become updated in the IRS’s system and your form can get rejected during that time. Even though you’ll get your EIN instantly when you apply for one, you have to wait for it to become active before you can file.

You also need to make sure that your business information matches the information that you have on file for your EIN with the IRS. If they don’t match then your form could get rejected. You can verify your information with the IRS by calling 1-888-829-4933.

Your Form is a Duplicate

Each VIN (Vehicle Identification Number) can only be filed for once during the HVUT tax period. Duplicates will be rejected, so make sure that you’re filing for the current tax period which runs from July 1st, 2017 to June 30th, 2018. If you accidentally filed for the previous tax period then that could be why your form is considered a duplicate.

You also need to make sure that you enter your VIN correctly. If it’s one character off then your form could get rejected. If your form is rejected for this reason don’t panic, you can quickly and easily file free VIN corrections with ExpressTruckTax.

RTN Errors

You can pay the amount of HVUT you owe to the IRS through direct debit or electronic funds withdrawal, and that process involves providing your bank account number and RTN (Routing Transfer Number).

If you enter this information with as little as one character off the IRS will not be able to debit the funds and your form will be rejected. This is also the case if you do not have enough funds in your account to cover the full amount.

How To Pay Your 2290 Tax When E-filing

How To Pay Your 2290 HVUT

Form 2290 is used to pay your HVUT or heavy vehicle use tax. If you’re in a highway motor vehicle that has a taxable gross weight of 55,000 pounds or more then you have to file e-file a HVUT 2290 form in order to get a copy of your Stamped Schedule 1. E-file means electronically filing online.

A highway motor vehicle includes vehicles that are designed to carry loads over public highways, whether they were also designed to perform other functions or not and that are self-propelled. These vehicles generally include buses, tractor trailers, and large trucks. Vans and pickup trucks tend to weigh less than 55,000 pounds.

The weight only includes the vehicle and it’s chassis or body, not it’s load. The type of load doesn’t matter either, the vehicle can be designed to passengers, supplies, or cargo.

Also, a public highway includes any road in the United States that isn’t private, including city, county, state and federal roads.

Your form 2290 is due the last day of the 2nd month after you first use your new qualifying vehicle. For example, if you first start driving a new qualifying vehicle in February then your Form 2290 would be due by March 31st. Also, the form 2290 needs to be renewed annually by August 31st.

When you file your form 2290 you have to pay your HVUT and you have a few different options for doing that.

You can pay with EFW or Electronic Fund Withdrawal, which is the option offered when you e-file your federal taxes with the use of IRS authorized preparation software, like ExpressTruckTax, or through a tax professional.

With EFW you enter in your bank account information to the IRS’s safe and secure payment system and the tax amount you owe is withdrawn from your bank account usually within 24 to 48 hours of submitting your payment.

Another payment option you have is to pay with the EFTPS or Electronic Federal Tax Payment System. If you select that option you will be taken to the EFTPS site. EFTPS is the free safe and secure payment system that’s offered by the U.S. Department of the Treasury.

To use the EFTPS you will need to create a free account, enter your bank account information, and verify it because this payment system works by withdrawing the funds you owe from your bank account.

Also, you have the 3rd option of mailing a check or money order to the IRS directly. Just make sure that the check or money order is payable to the U.S. Treasury and includes your name, address, EIN, “IRS form 2290”, and the date. Do not send cash.

If you choose to send a check or money order you’ll need to print the payment voucher 2290 -V, or page 5 of your 2290 and include it with your payment. Don’t staple your payment to your form 2990 or payment voucher.
