When a new vehicle is placed in service, the Form 2290 must be filed by the last day of the following month. So vehicles that were placed in service during the month of April will need to file HVUT using the 2290 by May 31st.

Your tax will be prorated based on the number of months the vehicle will have been used during the tax year. If a vehicle was used during any part of a month, the tax will be calculated for that month as a whole. For example, if a vehicle was used on April 20th, it will be taxed as though it was used the entire month, regardless of the fact it was only used for a couple of days, and the tax will be based on 3 months, instead of the full year.

Reminder: Tomorrow is the Deadline to File Form 2290

Tomorrow, April 30th is the deadline to file Form 2290 for Heavy Vehicles first placed on public highways during the month of March. IRS Form 2290, is the form you use to file your Heavy Vehicle Use Tax or HVUT.  this tax is imposed by the federal government in order to help pay for the damage done to our public highways by vehicles that weigh 55,000 or more.

Form 8849-Claim For Refund of Excise Taxes

What is the Heavy Vehicle Use Tax (HVUT) Used For?

The Heavy Vehicle Use Tax or HVUT is an annual fee assessed on heavy vehicles operating on public highways at registered gross weights equal to or exceeding 55,000 pounds. The gross taxable weight of a vehicle is determined by adding the unloaded weight of the motor vehicle and any trailers together with the maximum load customarily carried on-road by the truck-trailer combination. IRS Form 2290 is filed annually to pay the HVUT due on the taxable vehicle and proof of payment is the Stamped Schedule 1.

The damage to the road surface caused by heavy trucks is 160,000 times more than that of a car, according to the findings of the American Association of State Highways Official (AASHO) road test. The tax, which is based on the vehicle weight, is a significant source of transportation funding in the US. The HVUT ensures that operators of heavy trucks pay a little more for the highway network relative to the motorists than the light trucks who meet their responsibility through other forms of taxes (e.g., registration fees, motor fuel taxes) but do less damage to the system.  The monies collected are used to help pay for road repairs and maintenance.

EIN Is REQUIRED to File Form 2290

If you are filing Form 2290 for Heavy Vehicle Use Tax (HVUT), you must have an EIN to file the return. The IRS does not accept Social Security Numbers for the Form 2290. An EIN is an Employer Identification Number, also known as a Federal Tax Identification Number, and can be used to verify a business entity.

If you do not have an EIN, you can apply for one online through the IRS website or if you don’t have the time or unable to get to a computer, you can have a service provider, like Truck Services of North America to do it for you.

NOTE: Remember, for vehicles first used in March, the due date to file your Form 2290 is April 30, 2013. While you can get your EIN immediately, it can take the IRS up to 10 business days to update new EINs into their system; so you will want to get your EIN today to ensure it is in the system by the deadline!

Correcting Information on Form 2290

There are occasions when the information needs to be corrected on Form 2290 after it has been submitted and accepted by the IRS.  The process to correct the information depends on what information needs to be corrected.

Many corrections will require a phone call to the IRS at 866-699-4096.  For typos, misspellings and name corrections, you will want to correct the information on your Schedule 1 and fax it into the IRS and the IRS will make the corrections.  They may require additional information to confirm the correction, but will let you know when you call the number listed above.

If you have the wrong EIN on your Schedule 1, you will want to correct the EIN and fax it along with a letter explaining that the EIN was wrong.  If the return was accepting with an EIN that was not yours, it means the EIN belongs to someone else and the IRS will have to figure out whose payment you made.  If you are told that you need to file a new 2290 and pay the taxes again and then file for a refund using Form 8849, call back until you talk to someone who will assist you without making you pay the tax again and have to wait for a refund.

If your business name changes for any reason, but the EIN remains the same, you will change the business name and fill out the Name Change form and MAIL to the IRS.  A fax will not be accepted as an original signature is required.

What is My First Use Month?

When E-Filing Form 2290 with ExpressTruckTax, you will be asked to provide the first use date for the vehicle. This dates refers to the time when the vehicle was placed in service during the tax period.  If the vehicle has been placed in service for  previous years and will continue to be in service this year, the first use month will be July.  This is because the tax period for Heavy Vehicle Use Taxes begins in July and ends in June.

If a new vehicle is placed in service during the tax period, the first use month will be the month in which the vehicle was first used. If a vehicle was only used for part of the tax period, the tax will be prorated.
