Form 2290 Amendments

A Form 2290 Amendment, is quite simply, an adjustment or modification to the IRS Form 2290 for Heavy Vehicle Use Taxes.

Common reasons to file a Form 2290 amendment include:

  • VIN Corrections – A VIN correction would need to be filed if an error was made on the 2290 when entering the 17 character Vehicle Identification Number
  • Taxable Gross Weight Increase – If a 2290 was filed with an incorrect gross weight listed for the vehicle
  • Mileage Exceeded – If a Form 2290 was filed, as a “Suspended Vehicle” and it exceeded the 5,000 mile threshold

The easiest way to File this form is online through ExpressTruckTax.com. As an IRS approved E-File provider, ExpressTruckTax can E-File a 2290 Amendment in just minutes! You can even File a VIN correction for Free. Simply choose the Form 2290 Amendments option as shown below.

Form 2290 Credit Vehicles

IRS Form 2290, Highway Heavy Vehicle Use Tax claiming credit for the following scenarios:

  • You can take credit for the vehicle if it was stolen, destroyed or sold before June 1 and not used during the remainder of the period, or
  • Used during the prior period 5,000 miles or less (7,500 miles or less for agricultural vehicles).

A credit, lower tax, exemption, or refund is not allowed for an occasional light or decreased load or a discontinued or changed use of the vehicle.  What that means is if you filed your Form 2290 at 80,000 lbs, but had occasions where you operated at a lower weight class, that will not qualify you for a credit.  If you used your vehicle for only a portion of the tax year, you will qualify for the credit IF you did not exceed 5,000 miles (7,500 miles for agricultural vehicles).  If you did travel more than 5,000 miles (7,500 miles for agricultural vehicles) then you will NOT qualify for the credit.

The credit for vehicles that were stolen, destroyed or sold during the tax year will be prorated based on the dates of the occurrence.  For vehicles sold, destroyed or stolen, you must include the VIN, taxable gross weight, and date of sale, accident or theft. The credit for the tax paid can be claimed on the next Form 2290 filed or the refund can be claimed on Form 8849.  You do not have to wait until the tax period ends.

The credit for low mileage vehicles you either qualify for it and you will get the full amount that you paid as a credit or you will not qualify and you will not get any portion of the credit.  This credit is never prorated. For vehicles that tax was paid and the vehicles were used 5,000 miles or less (7,500 miles or less for agricultural vehicles), the credit (or refund) cannot be claimed until the end of the tax period for which the initial tax was paid.  Even if you know at some point during the tax year that you will not exceed the 5,000 mile mark, you will not be able to claim the credit until the tax period ends, which is on June 30th.
The credit claimed cannot exceed the tax reported on Form 2290. If this occurs, any excess credit must be claimed using Form 8849, Claim for Refund of Excise Taxes, and Schedule 6, Other Claims. When you use ExpressTruckTax to E-File your Form 2290, if your credit exceeds the tax due, our program will automatically generate the Form 8849 for you.  No need to enter any additional information!

EIN Is REQUIRED to File Form 2290

If you are filing Form 2290 for Heavy Vehicle Use Tax (HVUT), you must have an EIN to file the return. The IRS does not accept Social Security Numbers for the Form 2290. An EIN is an Employer Identification Number, also known as a Federal Tax Identification Number, and can be used to verify a business entity.

If you do not have an EIN, you can apply for one online through the IRS website or if you don’t have the time or unable to get to a computer, you can have a service provider, like Truck Services of North America to do it for you.

NOTE: Remember, for vehicles first used in August, the due date to file your Form 2290 is September 30, 2013. While you can get your EIN immediately, it can take the IRS up to 10 business days to update new EINs into their system; so you will want to get your EIN today to ensure it is in the system by the deadline!

Once your EIN is in the IRS system or if you already have one, you can file your Form 2290 return and receive your Stamped Schedule 1 within minutes at ExpressTruckTax. Form 2290 HVUT Requirements

The heavy vehicle use tax or HVUT is an annual fee assessed on heavy vehicles operating on public highways at registered gross weights equal to or exceeding 55,000 pounds. The gross taxable weight of a vehicle is determined by adding the unloaded weight of the motor vehicle and any trailers together with the maximum load customarily carried on-road by the truck-trailer combination. IRS Form 2290 is filed annually to pay the HVUT due on the taxable vehicle and proof of payment is the Stamped Schedule 1. The monies collected are used to offset the cost for road repairs and maintenance.

Suspended vehicles (Category W) are still required to file a Form 2290, even though there is no tax due.  A vehicle is considered suspended if the motor vehicle does not exceed 5,000 miles or 7,500 miles for agricultural vehicles during the tax period, regardless of owners.

An agricultural vehicle is any highway motor vehicle that is:

  • Used (or expected to be used) primarily for farming purposes, and
  • Registered (under state laws) as a highway motor vehicle used for farming purposes for the entire period. A special tag or license plate identifying the vehicle as used for farming is not required for it to be considered an agricultural vehicle.

Also note that logging vehicles are taxed at a reduced rate.

There are some vehicles that are exempt from the tax and are not required to file Form 2290. They are:

  • The Federal Government,
  • The District of Columbia,
  • A state or local government,
  • The American National Red Cross,
  • A nonprofit volunteer fire department, ambulance association, or rescue squad,
  • An Indian tribal government but only if the vehicle’s use involves the exercise of an essential tribal government function,
  • A mass transportation authority if it is created under a statute that gives it certain powers normally exercised by the state,
  • Qualified blood collector vehicles (see below) used by qualified blood collector organizations, or
  • Mobile machinery that meets the specifications for a chassis
  • For more information on exempt vehicles, go to irs.gov/trucker.

The IRS has simplified the process of filing Form 2290 and paying your HVUT taxes with the ability to E-File.  Anyone who is filing a return with 25 or more vehicles is required to file electronically, but everyone is now encouraged to E-File.  Through an IRS Authorized E-File Provider, like ExpressTruckTax.com, you can file your Form 2290, pay your HVUT taxes owed to the IRS and receive your Stamped Schedule 1 within minutes.  Your Schedule 1 serves as proof of payment for your HVUT and when you file by the deadline you will avoid any IRS penalties.
